MEMBERSHIP AGREEMENT
MEMBERSHIP
This membership entitles you to admission for regularly-scheduled group classes as published on Yoga Garden SF, dba Folk’s website and app.
Membership does not guarantee a space in class. Advanced reservations are required for classes and can be made online at folksf.com or through the Folk app.
Class schedules vary by location and are subject to change. Amenities, services and parking vary per location and are subject to change.
PAYMENT
As a convenience to me (Member), I hereby authorize Yoga Garden SF, dba Folk to initiate 12 monthly debit entries to my account provided, except as otherwise provided herein.
In the event that Member’s balance is unpaid on the following billing cycle, Member will be subject to a $10.00 late fee for each unpaid monthly debit.
Monthly debits are charged on the one-month anniversary of the original purchase.
Member may change the credit or debit card used to pay the monthly debit by updating their card information on their union.fit account.
Member should be aware of their billing date (the day of each month when funds will be drawn on the Member’s account).
Member grants Yoga Garden SF, dba Folk the right to re-debit a declined account and update banking or credit card account information provided by Member’s banking institution.
TERMINATION
This agreement will automatically terminate one month after the 12th payment has been paid (the Termination Date).
To cancel this agreement prior to the Termination Date, Member’s account must not have an outstanding balance and Member will be charged an Early Termination Fee of $360. Member must provide written notice which states that you (Member) are canceling this Agreement, or words of similar effect. Such notice shall be emailed to frontdesk@folksf.com or through the Contact Us form at folksf.com . Member will receive confirmation that the cancellation has been processed and is complete. If you do not receive confirmation that the account has been canceled, the account will remain active. Yoga Garden SF, dba Folk does not accept cancellations in person, over the phone or any other way than stated above.
Your membership is nontransferable and not assignable.
FREEZE
Folk Charter Memberships may be put on Freeze for up to (2) two months during the term of this Agreement by completing and sending a freeze request to frontdesk@folksf.com. There can only be no more than two separate freezes during the term of the membership, and the total of the freezes may not exceed 2 months. During the Freeze period, Member can not use the membership to access classes or activities of Yoga Garden SF, dba Folk. Member will receive confirmation that your account is frozen. If you do not receive confirmation, your freeze request has not been completed. A Freeze must be completed prior to the Freeze period.
FINANCIAL
Prepaid dues, prepaid membership payments, personal training and any other fees are non-refundable.
Yoga Garden SF, dba Folk, can sell memberships at different rates and terms than your membership. Member must pay their dues even if he/she does not use the membership. Yoga Garden SF, dba Folk reserves the right to use a 3rd party collection agency if Member’s dues are unpaid, the cost of which will be paid by Member upon collection.
Yoga Garden SF, dba Folk, at its sole discretion, may terminate the membership if the monthly payments are interrupted or discontinued for any reason or if Member’s conduct is improper or harmful to the operation of Yoga Garden SF, dba Folk. Member is liable for all financial obligations to that date.
This Agreement and all the terms and conditions contained herein applies to Member, Member’s heirs, executors, administrators, and assigns.
A Member’s heirs or representatives have the right to cancel this contract in the event of death of Member. If Member becomes disabled and unable to receive all services as contracted due to disability, Member shall have an option to extend the duration of the contract for a period equal to the duration of the disability up to a maximum of six months. The Member agrees that in the event they claim disability, the Member shall submit copies of Member’s physician’s applicable records which precludes Member from using the facilities or services provided by the membership and the condition is verified by a physician legally authorized to practice medicine.
CLOSURE
Yoga Garden SF, dba Folk, as a whole or individual locations, may be temporarily closed for holidays and for periods of up to two weeks each year for maintenance purposes without extensions to the membership.
ENTIRE AGREEMENT CLAUSE
Member acknowledges that neither Yoga Garden SF, dba Folk, nor anyone else has made any representations or promises upon which he/she relied that are not stated in this Agreement. This document contains the entire agreement between Member and Yoga Garden SF, dba Folk, and replaces any oral or other written agreement. If a court of law declares any part of this Agreement invalid, it will not invalidate the remaining parts, which continue to be unaffected. Should Yoga Garden SF, dba Folk, not enforce any right in this Agreement for any reason, Yoga Garden SF, dba Folk, does not waive its right to enforce it later.
